Terms of Service

1. Acceptance of Terms

Tap2NFC (the “Service”) is operated by Aspelta, a DBA of FracAppz LLC (“we”, “us”, or “our”). By accessing and using the Service, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Tap2NFC provides a platform for restaurants to create, manage, and distribute digital menus via NFC technology. The service includes:

• Digital menu creation and management tools
• NFC tag provisioning and management
• Multi-language menu support
• Analytics and reporting dashboard
• Template designs and customization options

3. User Accounts

To use our Service, you must:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. Subscription, Payment, and Hardware

By signing up for our service, you agree to the following payment terms:

• Subscriptions are billed monthly or annually in advance based on your selected plan
• You authorize us to charge your payment method on file
• Failed payments may result in service suspension
• You can cancel your subscription at any time
• No refunds for partial months of service

NFC hardware (such as NFC Table Tags and Stands) may be purchased as one-time orders through the Service. Hardware prices are shown at checkout, and payment, tax, and shipping are processed by Stripe. Orders ship to the address you provide, and title and risk of loss pass to you upon delivery. Hardware sales are final, except for items that arrive defective or damaged, which we will replace at no charge if you contact us within 30 days of delivery.

5. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, or offensive
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit viruses or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service

6. Content Ownership

You retain all rights to content you upload to the Service (menu items, images, descriptions, etc.). By uploading content, you grant us a license to use, store, and display that content solely for the purpose of providing the Service to you.

7. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

8. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

9. Limitation of Liability

To the maximum extent permitted by law, Tap2NFC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

10. Governing Law

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to its conflict-of-laws principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Texas.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
